NOTICE OF ASSOCIATION LIEN FORECLOSURE SALE 

WHEREAS, default has been made in the terms and conditions of the Declaration of Morgan Square Homeowners Association (henceforth the Declaration) dated June 19, 2003 and recorded in the office of the County Recorder in and for Dakota County, Minnesota on December 5, 2003 as Document No. 2148492 which said Lien covers the following described property situated in the County of Dakota and State of Minnesota, to-wit: 

Lot 17, Block 1, Morgan Square, C.I.C. No. 373, according to the plat thereof on file or of record in the Office of the County Recorder, in and for Dakota County, Minnesota. 

Street address: 20555 Keystone Avenue, Lakeville, MN 

PID # 22 48800 01 170 

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by Mary N. Ndegwa as unit owner, to Morgan Square Homeowners Association, the principal amount of Two Thousand Eighty-three Dollars and 75/100 ($2,083.75) for assessments through August, 2018 and no action being now pending at law or otherwise to recover said debt or any part thereof, and; 

WHEREAS, pursuant to said Declaration, said debt creates a lien upon said premises in favor of Morgan Square Homeowners Association. 

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Dakota County, Minnesota at the Sheriff’s main office, Dakota County Courthouse, Civil Division, 1580 Highway 55-Lobby S-100 in the City of Hastings in said County on October 25, 2018 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorney’s fees as allowed by law. The time allowed by law for redemption by the unit owners, her personal representatives or assigns, is six (6) months from the date of said sale. 

TIME AND DATE TO VACATE PROPERTY: If the real estate is an owner-occupied single family dwelling, unless otherwise provided by law, the date on or before which the unit owners must vacate the property if the lien is not reinstated under section 580.30 or the property is not redeemed under section 580.23 is 11:59 p.m. on April 25, 2019. If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate the property is the next business day at 11:59 p.m.

PURSUANT TO MINNESOTA STATUTE §412.8511

NOTICE IS HEARBY GIVEN that a hearing will be held before the City Council on the 11th of September 2018, in the Mendota VFW Post 6690 located at 1323 Sibley Memorial Highway, Mendota, Minnesota 55150 at 7:30 p.m. to consider a proposed vacation of a portion of First Street except Sibley Memorial Highway and all right-of-way in the City of Mendota which lies between the south lines of Lots 1-5, and Block 4 and the north side of Sibley Memorial Highway, all in the City of Mendota.

1§412.851 VACATION OF STREETS. 

The council may by resolution vacate any street, alley, public grounds, public way, or any part thereof, on its own motion or on petition of a majority of the owners of land abutting on the street, alley, public grounds, public way, or part thereof to be vacated. When there has been no petition, the resolution may be adopted only by a vote of four-fifths of all members of the council. No vacation shall be made unless it appears in the interest of the public to do so after a hearing preceded by two weeks’ published and posted notice. The council shall cause written notice of the hearing to be mailed to each property owner affected by the proposed vacation at least ten days before the hearing. The notice must contain, at minimum, a copy of the petition or proposed resolution as well as the time, place, and date of the hearing.

UNANIMOUS ACTION OF MEMBER AND DIRECTOR OF TINY TOTS PRESCHOOL, INC. 

The following Unanimous Action is taken by the Member and Director of the corporation, pursuant to the provisions of Minnesota Statutes, Section 317.01, et seq., and the laws mandatory thereof, effective September 1, 1985. 

RESOLVED, that the Tiny Tots and Little Tykes Preschool, Inc., admits students of any race, color, national and ethnic origin to all the rights, privileges, programs and activities generally accorded or made available to students at the school. It does not discriminate on the basis of race, color, admissions policies, scholarship programs, athletic and other school administered programs.

NOTICE OF PUBLIC HEARING 

Notice is hereby given that the Planning Commission of the City of Sunfish Lake will meet on Wednesday, September 19, 2018, at 7:00 p.m. at St. Anne’s Episcopal Church located at Highway 110 and Charlton Road in Sunfish Lake, Minnesota to hold a public hearing to consider an application for a major site and building plan review and conditional use permit for 2 Sunfish Lane. The subject property is located within the R-1 Single Family Residential and Shoreland Overlay Districts. The subject parcel has lake frontage on Sunfish Lake. 

The applicant has purchased the property and wishes to demolish the existing home and build a new home at approximately the same location on the site. A major site and building plan review is required for building alterations exceeding 1,000 square feet in area. In addition, the applicant is requesting a conditional use permit for a garage exceeding 1,250 square feet and two accessory structures (swimming pool and detached garage). 

All written and oral statements on the project will be considered at the Planning Commission meeting. The Planning Commissioners will be conducting a public site visit at 6:25 p.m. the night of the meeting to make themselves familiar with the site and receive information regarding the land use application. Notice is hereby given that the City Council of West St. Paul will meet in the Council Chambers of the Municipal Center, 1616 Humboldt Avenue at 6:30 p.m. on Monday, September 24th, 2018 to consider the making of an improvement for:

The area proposed to be assessed for such improvement is the property abutting on and/or benefiting such street. The estimated cost of the Livingston Ave. improvement is $ 5,279,209. The estimated cost of the alley improvement is $29,281. 

At the public hearing, the City will have available a reasonable estimate of the impact of the special assessment by providing the anticipated amount of the future special assessment for each parcel proposed to be assessed; this amount will be an estimate only and is subject to change at the time the special assessments for the improvement project are actually levied. Such persons as desire to be heard with reference to the proposed improvement will be heard at this meeting.

NOTICE OF INTENT TO TEMPORARILY DRAWDOWN OF THOMPSON LAKE LOCATED IN THOMPSON COUNTY PARK; WEST SAINT PAUL, MINNESOTA AND NOTICE OF PUBLIC HEARING 

Notice is hereby given of the Dakota County Board of Commissioners’ intent to temporarily drawdown Thompson Lake approximately 2.6’ from the period of November 1, 2018 until spring of 2019, weather dependent. 

The Dakota County Board of Commissioners will hold a public hearing at 9:00 a.m. on September 18, 2018 in the County Board Room, Dakota County Administration Center, 1590 Highway 55, Hastings, Minnesota, for the purpose of receiving comments on the proposed temporary drawdown. A summary document of the proposed drawdown is available on the Dakota County website: www.dakotacounty.org. 

Email comments are preferred and can be sent to water@co.dakota.mn.us. Written comments will be accepted until 4:30 p.m. on September 14, 2018.
