NOTICE OF ASSOCIATION LIEN FORECLOSURE SALE 

WHEREAS, default has been made in the terms and conditions of the Amended and Restated Declaration of Regency Condominium Homes, Condominium No. 19 (henceforth the Declaration) dated November 1, 1990 and recorded in the office of the Registrar of Titles in and for Dakota County, Minnesota on March 20, 1991 as Document No. 240029, which said Lien covers the following described property situated in the County of Dakota and State of Minnesota, to-wit: 

Apartment No. B-19, Condominium Ownership No. 19, Regency Condominium Homes, according to the plat thereof on file or of record in the Office of the Registrar of Titles in and for Dakota County, Minnesota. 

(This is registered property, Certificate of Title No. 152809). 

Street address: 2007 122nd Street East Unit B-19, Burnsville, MN 

PID #02-03610-69-053 

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by Michelle A. Vansickle as unit owner, to Regency Homeowner’s Association the principal amount of Four Thousand Three Hundred Twenty-six Dollars and 26/100 ($4,326.26) for assessments, through September, 2018 and no action being now pending at law or otherwise to recover said debt or any part thereof, and; 

WHEREAS, pursuant to said Declaration, said debt creates a lien upon said premises in favor of Regency Homeowners Association. 

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Dakota County, Minnesota at the Sheriff’s main office, Dakota County Courthouse, Civil Division, 1580 Highway 55-Lobby S-100 in the City of Hastings in said County on December 6, 2018 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorney’s fees as allowed by law. The time allowed by law for redemption by the unit owner, her personal representatives or assigns, is six (6) months from the date of said sale. 

TIME AND DATE TO VACATE PROPERTY: If the real estate is an owner-occupied single family dwelling, unless otherwise provided by law, the date on or before which the unit owners must vacate the property if the lien is not reinstated under section 580.30 or the property is not redeemed under section 580.23 is 11:59 p.m. on June 6, 2019. If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate the property is the next business day at 11:59 p.m.

ON THE ADOPTION OF THE

2019 AGENCY PLAN AND CAPITAL FUND PLAN

FOR THE PUBLIC HOUSING PROGRAM 

NOTICE IS HEREBY GIVEN that the Housing and Redevelopment Authority of the City of South St. Paul (the “HRA”), South St. Paul, Minnesota, has developed its Annual Public Housing Agency (PHA) Plan and the Capital Fund Plan for the 2019 calendar year in compliance with the Quality Housing and Work Responsibility Act of 1998. A public hearing to review the plan will be held on Monday, October 8, 2018 at 6:30 P.M. in the Training Room of the South St. Paul City Hall located at 125 Third Avenue North, South St. Paul, Minnesota. A draft of the PHA plan is available for review at the HRA’s office located at 125 Third Avenue North, South St. Paul, MN and on the Agency’s website at http://www.southstpaul.org under News & Announcements. Anyone interested in commenting on the plan may do so in writing by October 8, 2018 or by attending the public hearing. NOTICE OF PUBLIC HEARING 

TO WHOM IT MAY CONCERN: 

Notice is hereby given that the South St. Paul Planning Commission will hold a Public Hearing on Wednesday, October 3, 2018 at 7:30 P.M. or as soon thereafter as the matter can be heard in the City Council Chambers of City Hall, 125 Third Avenue North, South St. Paul to consider the following: 

1) A continuation of the public hearing from September 5, 2018 regarding an application by Lodge Properties, LLC, Box 2188, Stillwater, MN 55082, to consider an amendment to the text of City Code Section 118-126 regarding the C-1 Retail Business District to allow for the operation of pet daycare, pet boarding, pet grooming, and veterinary uses in the district. 

2) An application by Jacob and Brittani Guzzetta, 2242 Jewell Lane, South St. Paul, MN 55075 for a variance to allow the construction of a 6-foot tall fence along the side yard of their property where the property abuts the front yard of the adjacent property. The property is generally located south of Wenworth Avenue, west of 21st Avenue North, north of 4th Street North and east of Burma Lane. 

3) An application by Ronald and Billie Jo Nelson, 2232 Caroline Lane, South St. Paul, MN 55075 for a Conditional Use Permit to allow for the construction of a second garage. The applicant is proposing to extend the driveway of the existing attached 1-car garage to the rear of the property to construct a 24’x26’ detached 2-car garage. The property is generally located south of Jewell Lane, west of Burma Lane, north of Hansen Lane and east of Isalona Lane. 

4) An application by Lionheart LLC, dba Alibi Drinkery, 5625 Lower 182nd Street W., Farmington, MN 55024 for a Conditional Use Permit to allow on sale liquor for a restaurant/bar establishment at 211-229 13th Avenue South. The property is generally located north of 3rd Street South, south of Southview Blvd., east of 13th Avenue North and west of 12th Avenue North. 

5) An application by the City of South St. Paul, 125 Third Avenue North, South St. Paul, MN 55075, for a Preliminary and Final Plat of the property at 680 Verderosa Avenue. The proposed plat would divide the property into two lots plus an outlot. The property is generally located south of Interstate 494, west of the Mississippi River, north of Richmond Street East, and east of Hardman Avenue South. 

6) The Planning Commission will review and discuss a draft of the Parks, Trails and Open Space chapter from the Comprehensive Plan for the 2018 Comprehensive Plan Update. 

The Planning Commission will hold a joint work session with the Economic Development Advisory Board and Economic Development Authority prior to the regular meeting to discuss the 2018 Comprehensive Plan Update. The joint work session will begin at 5:30 pm in the Centennial Room at Central Square Community Center, 100 7th Ave. N., South St. Paul, MN 55075.

NOTICE OF HEARING ON PROPOSED ASSESSMENTS 

Notice is hereby given that the West St. Paul City Council will meet at 6:30 p.m. on October 8, 2018 in the Council Chambers of the Municipal Center, 1616 Humboldt Avenue to pass upon proposed assessment for unpaid invoices for weed cutting, ice abatements, repeat nuisances, I/I surcharges, and false alarm charges.

The proposed assessment roll is on file for public inspection in the office of the City Clerk, and written or oral objections thereto by any property owner will be considered at said hearing. 

YOU ARE FURTHERED NOTIFIED, that no appeal may be taken to District Court as to the amount of any assessment adopted by the Council after said hearing unless a written objection, signed by the affected property owner, is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. 

Any property owner may then appeal an assessment to District Court pursuant to MN Statues; by thereafter serving Notice of Appeal upon the Mayor or City Clerk within 30 days after the adoption of the assessment and filing such notice with the District Court within 10 days after service upon the Mayor or City Clerk.

AREA SCHOOLS

Monday, September 17, 2018

SCHOOL BOARD MEETING AND WORK SESSION 

A school board meeting and work session were held at 5:00 p.m. on Monday, September 17, 2018 at Henry Sibley High School, Room A-241, 1897 Delaware Avenue, Mendota Heights, MN. The following board members were present: John Chandler, Brenda Corbett, Stephanie Levine, Joanne Mansur, Maureen Ramirez, Byron Schwab and Terry Stamman. Superintendent Peter Olson-Skog was present. Student Representative Sonja Hanson was present. 

Motions carried to approve the agenda and consent agenda. The consent agenda included the minutes from the September 5, 2018 meeting; personnel recommendations; final reading of Policy 722; and gifts to the district. 

A motion carried to approve a bus lease. 

A motion carried to adopt the proposed 2018 payable 2019 property tax levy. 

A first reading of Policy 406, Public and Private Personnel Data, was presented. 

A motion carried to approve changes to Policy 501, School Weapons. 

A motion carried to approve changes to Policy 506, Student Discipline. 

A work session followed. Updates were provided on the facilities design process; the ADSIS (Alternative Delivery of Specialized Instruction Services) program; the draft 2018-19 Superintendent goals; and the draft 2018-19 School Board goals. 

The meeting adjourned at 7:15 p.m. 

The next regularly scheduled School Board meeting of Independent School District 197 is scheduled for Wednesday, October 3, 2018 at 6:00 p.m. at the Mendota Heights Council Chambers, 1101 Victoria Curve, Mendota Heights, MN.
