PARTIES AND JURISDICTION 

1. At all times pertinent hereto, Plaintiff Javier Hardwood Floor, LLC (“Plaintiff”) is a corporation with its principal place of business located in Minnesota. 

2. At all times pertinent hereto, Defendant Robert Stein is an individual residing in St. Paul, Minnesota. 

3. At all times pertinent hereto, Defendant RDS Investments Co. (“Defendant”) is a Minnesota corporation.

COUNT I 

4. That Plaintiff agreed to perform certain services for Defendants, memorialized by an invoice (hereinafter referred to as “the Invoice”) on or around February 2017. Plaintiff performed said services for Defendant, however the Defendants never paid for the services performed per the parties’ agreement. 

5. That Defendants owe to Plaintiff the sum of $7,300 for the services performed. 

6. That although duly demanded, Defendants have failed to pay said amount and therefore is indebted to the Plaintiff in the amount of $7,300, plus interest, statutory costs, and court costs.

COUNT II 

7. Plaintiff repeats and realleges each and every allegation contained in paragraphs 1 through 5 of this complaint as though fully set forth at length herein. 

8. Defendants benefitted from the services, has acknowledged receipt of those services, and has failed to pay for same. 

9. Given Defendants’ failure to make payments for the outstanding balance owed with respect to the services, and the fact that Defendants were the beneficiary of the services, Defendants would be unjustly enriched to Plaintiff’s detriment unless judgment is entered for the full balance due and owing for services performed. 

10. By reason of the foregoing, Plaintiff is entitled to judgment against Defendants for unjust enrichment in an amount of $7,300, plus interest, statutory costs, and court costs. 

WHEREFORE, Plaintiff demands judgment against defendant as follows: 

1. For the principal amount of $7,300 plus interest, statutory costs, and court costs; 

2. For Plaintiff’s costs and disbursements incurred herein; and

the County, the assessments are payable in equal annual installments extending over a period of 15 years for street and drainage improvements, the first of the installments to be payable on or before the first Monday in January 2019 and will bear interest at the rate of 4.00 percent per annum from the date of adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2018. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 

The proposed assessment roll is on file for public inspection at the City Clerk’s office. The total amount of the proposed street improvement assessment is $377,500. The City contribution for the overall improvement project is $874,500. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The Council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. 

An owner may appeal an assessment to district court pursuant to Minnesota Statutes, Section 429.081 by serving notice of the appeal upon the Mayor or Clerk within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or Clerk. 

The City Council is authorized in its discretion to defer the payment of an assessment for any homestead property owned by a person for whom it would be a hardship to make payment if the owner is 65 years of age or older and/or the owner is a person retired by virtue of a permanent and total disability or by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service, as defined in section 190.05 subdivision 5b or 5c, as stated in the person’s military orders, for whom it would be a hardship to make the payments. The owner must request a deferment of the assessment at or before the public hearing at which the assessment is adopted and make application on forms prescribed by the City Clerk within 30 days after the adoption. 

Notwithstanding the standards and guidelines established by the City for determining a hardship, a deferment of an assessment may be obtained pursuant to Minnesota Statutes Section 435.193.

That The City of Landfall Village Municipal Code, § 670.11, is hereby adopted to reflect the City’s policy regarding Outside Storage on lots in the City. 

Sec. 670.11 Outside Storage of Personal Property Including Materials or Goods. 

All Personal Property, Materials and Goods shall be stored within the home or storage shed. No items shall be permitted to be stored on top of, beside, or under the home (see Exemption) porch/deck, addition, shed or on trailers. One ladder may be stored outside in a safe and secure manner. Items allowed in yards or patios: 

ANYTIME – Patio Furniture and Bar-B-Que grill/smoker. SUMMER –Kiddie pool, kiddie outdoor furniture, kiddie bikes/toys and seasonally appropriate yard accoutrements. Exemptions: a.) Building materials or equipment being actively used in construction for time stated on building permit and b.) Limited storage is allowed under the home for non-flammable items that can be secured, do not block access to utilities and allow the home to be properly and securely skirted.

NOTICE IS HEREBY GIVEN that the Planning Commission for the City of Oakdale, Minnesota, will hold a public hearing at 7:00 p.m. on Thursday, October 4th, 2018 in the Council Chambers of the Municipal Building, 1584 Hadley Avenue North. The purpose is to review the comprehensive plan and zoning map amendments for the area being re-platted located north of the intersection of 36 and Hadley Avenue (Legal Description: Mills Second Edition to Oakdale Lot 1 Block 1 and Lot 2 Block 1).
