WHEREAS, default has been made in the terms and conditions of the Amended and Restated Declaration of the Oaks Homeowners Association (henceforth the Declaration) dated December 10, 2013 and recorded in the office of the County Recorder in and for Dakota County, Minnesota on February 27, 2014 as Document No. 3000335 and in the Office of the Dakota County Registrar of Titles as Document No. T728905 which said Lien covers the following described property situated in the County of Dakota and State of Minnesota, to-wit:

2018 IMPROVEMENT PROGRAM 

TO WHOM IT MAY CONCERN: 

Notice is hereby given that the City Council of Inver Grove Heights will meet in the City Council Chambers at 8150 Barbara Avenue, Inver Grove Heights, MN at 7:00 p.m. on Monday, December 11, 2017, to hold a public hearing to consider the making of the following improvements in the 2018 Improvement Program.

80th Street Sanitary Sewer Improvements (Robert District) 

Nature of Work 

Sanitary sewer alignment to extend the existing 80th Street 8-inch sanitary sewer along the existing 80th Street alignment. There is an existing 12-inch sanitary sewer stub located just east of the Amana Trail and Robert Street Roundabout that this line would connect to for conveyance to the Argental Hills regional lift station. A portion of the 80th Street pavement would be removed and replaced. Storm water facilities along the alignment will be restored. 

Estimated Cost of Improvements: $1,320,200

NOTICE OF PUBLIC HEARING ON THE VACATION OF A PORTION OF 5TH STREET SOUTH

MINNESOTA STATUTES § 412.851 AND § 462.358, SUBD. 7 AND CITY CODE SECTION 54-428 

TO WHOM IT MAY CONCERN: 

PLEASE TAKE NOTICE: 

1. The City of South St. Paul received the dedication of a sixty-foot right-of-way known as 5th Street South as shown on the plats of Tarbox Addition to South St. Paul and Riverside Park Addition to the City of St. Paul. 

2. Pursuant to that resolution adopted on June 5th, 1978 by the City Council of the City of South St. Paul and recorded in the Office of the County Recorder of Dakota County, Minnesota, as Document No. 517982, the following portions of the right-of-way known as 5th Street South and dedicated on the plats of Riverside Park Addition to the City of St. Paul and Tarbox Addition to South St. Paul were vacated: 

The North 27.5 feet and the South 27.5 feet of that part of 5th Street South lying between the West line of Concord Street and a line described as:

Pursuant to Minnesota Statutes § 412.851 and § 462.358, subd. 7, the City of South St. Paul shall hold a public hearing on the proposed vacation of the remainder of any unvacated portion of the right of way known as 5th Street South dedicated on the plats of Riverside Park Addition to the City of St. Paul and Tarbox Addition to South St. Paul lying between the West line of Concord Street and a line described as: 

Commencing at the Northwest corner of Lot 1, Block 10, Tarbox Addition, thence Northerly to a point on the South line of Lot 20, Block 20, Riverside Park Addition 190 feet West of the Southeast Corner of said Lot 20. 

4. Notice is hereby given that the City Council of South St. Paul shall hold a public hearing on said proposed vacation at 7:15 p.m. on the 4th day of December, 2017, at the City of South St. Paul City Hall, 123 - 3rd Avenue North, South St. Paul, Minnesota, 55075.

AN ORDINANCE PROVIDING FOR THE VACATION OF A RIGHT-OF-WAY BY ORDINANCE PURSUANT TO CITY CODE 

The City Council of South St. Paul does ordain: 

SECTION 1. Pursuant to Minn. Stat. § 412.851 and South St. Paul City Code Section 54-428, on its own motion, with a vote of four of its members, the City Council may vacate any street, alley or public right-of-way within the City by Ordinance. 

WHEREAS, 5th Street South was dedicated to the City on the plats of Riverside Addition and Tarbox Addition; and 

WHEREAS, pursuant to that Resolution adopted by the City Council of the City of South St. Paul, on June 5th, 1978, subsequently recorded as Document No. 517928 on August 2nd, 1978, with the Office of the County Record in Dakota County, the following portion of 5th Street was vacated: 

The North 27.5 feet and the South 27.5 feet of that part of 5th Street South lying between the West line of Concord Street and a line described as: 

Commencing at the Northwest corner of Lot 1, Block 10, Tarbox Addition, thence Northerly to a point on the South line of Lot 20, Block 20, Riverside Park Addition 190 feet West of the Southeast Corner of said Lot 20; and 

WHEREAS, such vacation left a gap of approximately five feet of unvacated right-of-way lying in-between said vacated portions of 5th Street South; and 

WHEREAS, pursuant to Minnesota Statutes § 412.851 and § 462.358, subd. 7 and City Code Section 54-428, the City of South St. Paul held a public hearing on the proposed vacation of such portion of unvacated 5th Street legally described as follows: 

Any remaining unvacated portion of 5th Street South dedicated on the plats of dedicated on the plats of Riverside Park Addition to the City of St. Paul and Tarbox Addition to South St. Paul lying between the West line of Concord Street and a line described as: 

Commencing at the Northwest corner of Lot 1, Block 10, Tarbox Addition, thence Northerly to a point on the South line of Lot 20, Block 20, Riverside Park Addition 190 feet West of the Southeast Corner of said Lot 20. 

WHEREAS, notice of a public hearing on said vacation was duly published, posted and mailed in accordance with applicable Minnesota Statutes and a public hearing was held on the _____day of ________, 2017, at the City of South St. Paul City Hall, 123 - 3rd Avenue North, South St. Paul, Minnesota, 55075; and 

WHEREAS, the City Council of South St. Paul then proceeded to hear all persons interested in said vacation and all persons interested were afforded an opportunity to present their views and objections to said vacation; and 

WHEREAS, the City Council of South St. Paul has determined that the vacation would be in the public interest. 

NOW THEREFORE THE CITY OF SOUTH ST. PAUL DOES ORDAIN: 

1. 2. That said vacation has no relationship to the City’s Comprehensive Plan and therefore the South St. Paul City Council has dispensed with the requirements of Minn. Stat. § 462.356, subd. 2, that may require the South St. Paul Planning Commission to perform a Comprehensive Plan compliance review of said vacation that may constitute a disposal of real property pursuant to § 462.356, subd. 2 

SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication according to law.
