SUMMARY OF PROCEEDINGS WASHINGTON COUNTY BOARD OF COMMISSIONERS MARCH 11, 2014 Present were Commissioners Fran Miron, District 1; Ted Bearth, District 2; Gary Kriesel, District 3; Autumn Lehrke, District 4; and Lisa Weik, District 5. Commissioner Reports – Comments – Questions The Commissioners reported on the following items: - Commissioner Weik – reported she attended the Metropolitan Energy Policy Coalition meeting where she was elected vice chair; she reported she attended the National Association of Counties (NACo) legislative conference and gave a brief overview of the meetings and workshops she attended; - Commissioner Miron – reported he attended a legislative breakfast in Forest Lake hosted by the Chamber where the County Board was thanked for its action on the septic loan program; - Commissioner Lehrke – reported she attended the NACo legislative conference and gave a brief overview of the meetings and workshops she attended. Community Services Approval of the Community Development Block Grant (CDBG) funding agreement and an amendment that reallocates 2013 CDBG funds in accordance with the 2013 Annual Action Plan. General Administration Approval of the following actions: - March 4, 2014, Board meeting minutes; - The 2014 Budget Book has been distributed and is available for viewing on the county web site; - Today is the first day that the county is going live with webstreaming of County Board meetings; - Legislative update presented; - Board correspondence was received and placed on file; - Executive Session held to review the landowner’s counter to the county’s offer to purchase fee interest in the Aiple property for park purposes and the use of Land and Water Legacy bond funds; - Board workshop held to discuss legislative issues. Property Records and Taxpayer Services Approval of the following actions: - Application for a 1 to 4 day Temporary On-Sale Liquor License for the St. Croix Preparatory Academy located in Baytown Township; - Renewal of an On Sale and Sunday Liquor License for The Point, Inc., Denmark Township. Regional Railroad Authority Approval of the following actions: - RRA Minutes from January 28, 2014; - Amendment No. 3 to the Gateway Corridor strategic communications contract with Jeff Dehler Public Relations. Public Health and Environment Approval of the following actions: - Continuation of public hearing on proposed Groundwater Plan Draft 2014-2024; - Resolution No. 2014-024, submit the Washington County Groundwater Plan Draft 2014-2024 to the Metropolitan Council and State Review Agencies and the Board of Water and Soil Resources for final review; - Resolution No. 2014-025, directing the Washington County Attorney’s Office to file Brown’s Creek Watershed District boundary change petition with the Board of Water and Soil Resources. Public Works Approval of the following actions: - Non-Federal Subaward Agreement to accept a research grant from the University of Minnesota’s Operation Research Program for Local Transportation Groups (OPERA) program for $10,000 to facilitate new research on the effectiveness of reptile crossings beneath County State Aid Highway (CSAH) 4; and approve a budget amendment in the amount of $10,000 in revenue OPERA grant funding; - Resolution No. 2014-022, park house leases at 13485 St. Croix Trail South, Denmark Township; and 12005 165th Street North, Marine on St. Croix; - Amendment No. 2 to the Gateway Corridor Alternatives Analysis Capital Grant Agreement with the Counties Transit Improvement Board; - Permanent and temporary use of fund balance in the amount of $150,000 to pay clean-up and restoration costs at the Wildwood Library caused by water damage; - Contract with SRF Consulting Group, Inc. for design engineering for the CSAH 17 and Trunk Highway 5 intersection project. Commissioner Reports – Comments – Questions The Commissioners reported on the following items: - Commissioner Weik – asked that when the next citizen survey is conducted that a question be asked about election services in Washington County; and she reported that the Gateway Corridor Commission discussed touring a Bus Rapid Transit corridor; - Commissioner Miron – reported he attended meetings with city officials in Woodbury and Hugo to discuss water issues; and he mentioned an article in the St. Croix Valley Peach about the Honorable Judge McBride and his wife and the work they do on social issues. Community Services Approval of the following actions: - 2014-2016 contract with Meridian Services, Inc., to provide case management and other services for persons with developmental disabilities; - 2014-2016 contract with Community Involvement Programs to provide Mental Health nursing services for clients in the community; - 2014-2016 contracts with East Suburban Resources, Opportunity Services, and Phoenix Alternatives to provide day training and habilitation and related services for persons with disabilities. General Administration Approval of the following actions: - March 11, 2014, Board meeting minutes; - Resolution No. 2014-026, support state funding to assist Washington County Communities in providing clean, potable water in areas that have been contaminated; - Resolution No. 2014-027, supporting creation of advisory team to assist in Groundwater Management Area planning, House File 2528 and Senate File 2298; - Resolution No. 2014-028, supporting state assistance for water conservation projects within the City of Hugo, House File 2337 and Senate File 1712; - Legislative update on the Administrative Simplification in the Human Services area is moving forward; and the City of Bayport is asking for support in legislation that would allow the city to secure some surplus land at the south end of the Stillwater prison to build a new fire station and a workshop will be held next week to discuss this matter; - Board correspondence was received and placed on file; - Executive Session held to review the landowner’s response to the county’s latest offer to purchase interests in land owned by the Thomas E. and Edna D. Carpenter Foundation, Denmark Township; - Board workshop held to discuss the Economic Development Strategic Plan. RESOLUTION ADOPTING WASHINGTON COUNTY HAZARDOUS WASTE MANAGEMENT ORDINANCE #195 AND REPEALING HAZARDOUS WASTE MANAGEMENT ORDINANCE #187. WHEREAS, Minn. Stat. 473.811 Subd. 5b requires each metropolitan county to enact an ordinance which provides for the identification of; the labeling and classification of; the collection, storage, transportation, processing and disposal of; and other regulations touching on the public health, safety and welfare in regards to hazardous waste, and WHEREAS, Washington County’s regulation of hazardous waste through ordinance dates back to 1984, and WHEREAS, the current Washington County Hazardous Waste Management Ordinance is Washington County Ordinance #187 which was adopted on July 26, 2011, and WHEREAS, changes in the manner of dealing with certain waste streams has led to a determination by the Washington County Department of Public Health and Environment that a new hazardous waste management ordinance incorporating these changes would be beneficial to the health, safety and welfare of the County, and WHEREAS, on January 21, 2014 the Department of Public Health and Environment held a workshop with the Washington County Board of Commissioners to review proposed changes to the ordinance, and WHEREAS, on March 18, 2014 the Washington County Board of Commissioners conducted a public hearing pursuant to Minn. Stat. 375.51 to consider adopting a new hazardous waste management ordinance. NOW, THEREFORE, BE IT RESOLVED, that the Washington County Board of Commissioners hereby adopts Washington County Hazardous Waste Management Ordinance #195, to take effect upon the passage of this resolution and its publication according to law, and BE IT FURTHER RESOLVED, that the Washington County Board of Commissioners hereby repeals Washington County Hazardous Waste Management Ordinance #187, said repeal to take effect on the date that Washington County Hazardous Waste Management Ordinance #195 becomes effective. WASHINGTON COUNTY HAZARDOUS WASTE MANAGEMENT ORDINANCE #195 Pursuant to the authority contained in Minnesota Statutes section 473.811 subdivision 5b, on March 18, 2014, the Washington County Board of Commissioners enacted Washington County Hazardous Waste Ordinance #195 establishing the rules, regulations and standards for hazardous waste management in Washington County, Minnesota. The following is a summary of the Ordinance. The full text is available for public inspection at the Washington County Department of Public Health and Environment or on the Washington County website. The Ordinance sets forth parameters for the identification, labeling and classification of hazardous wastes including but not limited to special hazardous waste (electronics), universal wastes, appliances, and transfer facilities. The ordinance also sets out the manner in which the different classifications of hazardous wastes must be handled, collected, transported, stored, treated, processed and disposed. The ordinance establishes the requirements for the licensing of hazardous waste generators and hazardous waste facilities including the payment of license fees; the issuance of licenses; the denial of licenses; the imposition of conditions upon licenses; the penalties for failure to comply with the requirements; and the appeal process. The ordinance establishes the enforcement mechanisms for violations of the ordinance which include both civil and criminal sanctions. The ordinance also adopts by reference a number of the rules promulgated by the Minnesota Pollution Control Agency. In adopting Washington County Hazardous Waste Ordinance #195, the Washington County Board of Commissioners also repealed Washington County Hazardous Waste Ordinance #187.
