NOTICE OF ASSOCIATION LIEN FORECLOSURE SALE 

WHEREAS, default has been made in the terms and conditions of the Declaration of Morgan Square Homeowners Association (henceforth the Declaration) dated June 19, 2003 and recorded in the office of the County Recorder in and for Dakota County, Minnesota on December 5, 2003 as Document No. 2148492 which said Lien covers the following described property situated in the County of Dakota and State of Minnesota, to-wit: 

Lot 17, Block 1, Morgan Square, C.I.C. No. 373, according to the plat thereof on file or of record in the Office of the County Recorder, in and for Dakota County, Minnesota.

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by Mary N. Ndegwa as unit owner, to Morgan Square Homeowners Association, the principal amount of Two Thousand Nine Hundred Twenty-seven Dollars and 53/100 ($2,927.53) for assessments through January, 2018 and no action being now pending at law or otherwise to recover said debt or any part thereof, and; 

WHEREAS, pursuant to said Declaration, said debt creates a lien upon said premises in favor of Morgan Square Homeowners Association. 

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Dakota County, Minnesota at the Sheriffs main office, Dakota County Courthouse, Civil Division, 1580 Highway 55-Lobby S-100 in the City of Hastings in said County on March 29, 2018 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorneys fees as allowed by law. The time allowed by law for redemption by the unit owners, her personal representatives or assigns, is six (6) months from the date of said sale. 

TIME AND DATE TO VACATE PROPERTY: If the real estate is an owner-occupied single family dwelling, unless otherwise provided by law, the date on or before which the unit owners must vacate the property if the lien is not reinstated under section 580.30 or the property is not redeemed under section 580.23 is 11:59 p.m. on September 29, 2018. If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate the property is the next business day at 11:59 p.m.

Notice is hereby given that the City Council of Inver Grove Heights, MN, will meet in the Council Chambers at 8150 Barbara Avenue, Inver Grove Heights, MN, at 7:00 p.m. on Monday, February 26, 2018 to hold a hearing and to consider, pass upon and levy the proposed special assessments for improvements as follows:

Assessment Roll Available for Inspection 

The proposed assessment rolls are now on file for public inspection at the Clerk’s Office, 8150 Barbara Avenue, Inver Grove Heights, MN. You are invited to examine the assessment rolls prior to the hearing. City offices are open from 8:00 a.m. to 4:30 p.m., Monday through Friday; no appointments are necessary. The assessment rolls will be available for examination at the hearing. 

Objections and Appeals 

Written and oral objections will be considered at the hearing. Minnesota Statute, Section 429.061, states that no appeal may be taken as to the amount of the assessment unless a written objection, signed by the affected property owner, is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. An owner may appeal an assessment to the District Court pursuant to Minnesota Statute, Section 429.081, by serving notice of the appeal upon the Mayor or the Clerk of the City within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or the Clerk. 

Assessment Deferment 

Under Minnesota Statutes, Section 435.193 to 435.195, the Inver Grove Heights City Council may, in its discretion, defer the payment of these special assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments, any homestead property owned by a person who is retired by virtue of a permanent and total disability, for whom it would be a hardship to make the payments, any homestead property owned by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service (as defined in Minnesota Statutes Section 190.05, subdivision 5(b) or 5(c)), as stated in the person’s military orders, for whom it would be a hardship to make the payments. When deferment of the special assessments has been granted and is terminated for any reason provided by law, all amounts accumulated, plus applicable interest, become due. Any assessed property owner meeting the requirements of this law and Resolution No. 09-13, adopted under it, may apply to the City Clerk on the prescribed form for such deferral of payment of these special assessments. If you qualify and wish a deferment, then contact the City Clerk. 

Authority to Specially Assess 

The proposed assessments are to be levied pursuant to Minnesota Statutes, Chapter 429. The improvements are proposed to be assessed on the combined basis of the frontage, current or future access of properties abutting or tributary to said improvements, and the number of units served. The areas, parcels, lots and pieces of property, as specially described herein, are subject to said assessments. The amounts set forth in this Notice are the proposed assessments. The City Council will consider the proposed assessments at the meeting and may levy the assessments at the meeting or at a later date. The City Council may levy and adopt special assessments that are the same or different than the proposed amounts. 

Payment of Special Assessments 

Once the special assessments are levied and adopted, the special assessments will be certified to the Dakota County Auditor to be extended on the property tax lists for collection with real estate taxes. Prior to this certification, however, the property owner may prepay the entire amount of the special assessment without any interest thereon provided the prepayment is received within 30 days after levy and adoption of the special assessments by the City Council (or at such later date determined by the City Council). If the property owner wishes to prepay the special assessments without any interest, then such payment must be made to the City of Inver Grove Heights at City Hall, 8150 Barbara Avenue, Inver Grove Heights, MN 55077. Partial prepayment of the special assessments is not presently allowed under the City ordinances; the prepayment, without interest, must be for the entire amount of the special assessments.

If prepayment is not received within thirty (30) days after the special assessments are levied and adopted by the City Council (or at such later date determined by the City Council), then: 

(a) The total principal amounts of the special assessments are divided into an equal number of annual installments. The proposed number of annual installments is ten (10) years. The number of annual installments will be decided by the City Council when the special assessments are levied. 

(b) The principal amounts of the special assessments shall bear interest at the rate determined by the City Council when the special assessments are levied. The proposed interest rate is 4.2 percent. 

(c) Interest begins to accrue from the date the special assessments are levied (or at such later date determined by the City Council). 

(d) The annual principal installments, together with interest accrued on the unpaid balance, are due and payable together with real estate taxes. 

(e) Interest on the entire special assessments, from the date of levy (or at such later date determined by the City Council) to December 31st of the year in which the first installment is payable, is added to the first principal installment. The first installment will be due and payable in 2019. 

(f) If in the future the property owner wishes to pay off the remaining balance of the assessments, then Minnesota Statute, Section 429.061, Subdivision 3, provides that such payment may be made to the County Treasurer, together with interest accrued to December 31st of the year in which payment is made as long as payment is made prior to November 15th; if the payoff occurs after November 15th, then interest for the next year is also added. 

If the adopted assessments differ from the proposed assessments as to any particular lot, piece or parcel of land, then the City will mail to the owner a notice stating the amount of the adopted assessments. Owners will also be notified, by mail, if the City Council adopts any changes in the interest rate or prepayment requirements from those contained in this Notice of Hearing.

The amendment to the Residential Rental Housing Ordinance accomplishes the following: 

X Clarifies that alternative inspection reports (i.e. insurance-related) are valid for a period of 12 months 

X Changes the city-approved inspection reports from every 4 years to every 3 years, beginning May 31, 2018 

X Clarified and added activity to the Maintenance Standards list for property owners and the Code of Conduct list for tenants to better identify incidents that may be used for documentation of nuisance behavior, which may lead to warning letters, fines or license revocation actions

Notice is hereby given that the South St. Paul Planning Commission will hold a Public Hearing on Wednesday, February 7, 2018 at 7:00 P.M. or as soon thereafter as the matter can be heard in the City Council Chambers of City Hall, 125 Third Avenue North, South St. Paul to consider the following:

2) An application for a PUD Amendment to allow for a 256 square foot addition to the feather scrubber tower from Sanimax Holding, Inc., 2099 Badgerland Avenue, Green Bay WI, 54303. The application states that the proposed addition would enhance the range of odors the feather scrubber can reduce from the process. The 16-foot-by-16-foot addition would not exceed the height of the current building and would be set back more than 140 feet from the property line. The property is generally located south of Amrour Avenue, west of the Mississippi River, north of Verderosa Avenue, and east of Hardman Avenue South. 

3) Review and discussion of sections from the Comprehensive Plan for the 2018 Comprehensive Plan Update.

Board Chair, Matt Schaefer, called the meeting to order at 5:33 p.m. 

2. Roll Call –Board Clerk, Sherry Warrick, took roll call.

5. District Highlights 

Pine Bend Physical Education teacher Kelly Darrow recently earned the American Heart Association’s Volunteer of the Year Award! She has raised more than $400,000 for the AHA thanks to her outstanding work on Jump Rope for Heart events. 

6. Non-Agenda Item—There were no non-agenda items presented. 

7. Consent Agenda 

Motion by Member Stensgard and a Second by Member Gliva to approve the Consent Agenda items as presented.

Thank you to those who have donated to the school district this past month. Your generosity in support of our schools in the community are much appreciated as they make a difference for our students. 

8. Information Items 

A. The Annual Truth-In-Taxation information item was provided by the Director of Business Services, Heather Aune. 

B. The ISD 199 Academic Calendar for 2018-2019 will be an action item at the January 22, 2018 board meeting. 

C. As part of the Inver Grove Heights Community School Board of Education’s Three Year Agenda, the board recently conducted a self-evaluation of performance in the areas of productivity, effectiveness and communication, both with the public and within the board. Each member filled out the evaluation and the results were compiled and shared at the meeting. 

D. Committee Reports 

I. Facilities Committee - Member Mandell shared the Facilities Committee met on Monday, December 4. The committee received a status update on the Simley High School Main Gym Sound System, Secondary Campus Clocks and Intercom update status, addition of additional activity outdoor practice space to be ball Prairie Fields and the Varsity Baseball Field Outfield fence which will be replaced next summer. The committee also discussed the South Grove property, the potential of purchasing property in proximity to Salem Hills Elementary, Capital Projects; specifically Learning Equipment and the 10 Year Facility Plan focusing on Color Boards for each site. 

II. Finance Committee - The Finance Committee did not meet this month. 

III. Personnel Committee - The Personnel Committee did not meet this month. 

IV. Policy - The Policy Committee did not meet this month. 

E. Membership Reports 

I. Equity Alliance MN – Member Nordstrom reported Equity Alliance had a personnel committee meeting last week and are working on an analysis of positions within the organization. Member Nordstrom is currently on the Equity Alliance MN finance and personnel committees and will also be on the non-profit board. 

II. Association of Metropolitan School Districts (AMSD) and Minnesota School Board Association (MSBA) – Member Mandell shared the MSBA Delegate Assembly was held on December 1 & 2. There were 12 resolutions that passed out of 19. The AMSD board of directors met on December 1. Mandell gave a speech about his time on the board.

A. Superintendent’s Comments 

The Inver Grove Heights School District Community has been fortunate for 12 years to have a school board member that has based his service on these three pillars. Paul, you are leaving your position with the school district in a better place than when you started. Thank you for your service to ISD 199. 

B. School Board Comments 

Board Chair, Matt Schaefer — I attended the MSBA Delegate Assembly meeting with Paul Mandell. Thank you to Paul for all of your years on the school board. Your public service is outstanding and speaks volumes to your character. 

Board Vice Chair/Treasurer, Sue Gliva — I would like to thank Paul Mandell for his 12 year of service on our school board. It has been a pleasure serving on the board with you. 

Board Clerk, Sherry Warrick— I attended a recent Reimagine MN event and it was one of the most inspiring events I have been to all year. I am proud of the Reimagine MN work and proud to be from a diverse district. Thank you to Paul for your commitment and passion for our kids of ISD 199. 

Board Member, Paul Mandell — The future of our district is indeed bright. I wish you all the best of luck in making it even better! You now have, with the successful passage of the levy and bond along with my replacement, a great head start! 

Board Member, Cindy Nordstrom — I was inspired tonight by the settlement of the teacher contract and continuing the collaborative nature that has been built with a mutual agreement. Paul, thank you for the past ten years. Your passion, commitment and patience to supporting education has influenced the direction ISD 199 educators, families, staff and community members have chosen. 

Board Member, Lynette Stensgard— Reimagine Minnesota was incredibly inspirational and our mission and vision that we have established aligns so well with what I heard. Paul, we have been together 12 years. Thank you for believing in me when I was just a parent with passion. We are going to miss you so much. Thank you for everything! 

Board Member, Rachel Hanson— I am thrilled to see all of the collaboration in our district. Paul, it has been a pleasure to serve on the board with you. 

11.Upcoming Meeting Dates 

There will be a Special Meeting on Monday, January 8th 5:30 p.m. A Work Session will follow. The next Regular School Board meeting will be on January 22.
