CITY OF SOUTH ST. PAUL NOTICE OF PUBLIC HEARING TO WHOM IT MAY CONCERN: Notice is hereby given that the South St. Paul Planning Commission will hold a Public Hearing on Wednesday, February 5, 2014 at 7:00 P.M. or as soon thereafter as the matter can be heard in the City Council Chambers of City Hall, 125 Third Avenue North, South St. Paul to consider the following: 1) An application for an Interim Use Permit (IUP) for temporary auto sales events for the property at 464 Concord Exchange south as proposed by Delacy Automotive, 528 Concord Exchange South, South St. Paul, MN 55075. The proposed IUP would allow up to 6 temporary auto sales on the property to the north of Delacy Automotive including parking space for up to 129 vehicles; which includes the customer parking spaces and the parking for the additional sales inventory. The sales events are proposed to run approximately every 60 days for the term of the Interim Use Permit would run through May 2015, with no more than 6 sales per year. CITY OF SOUTH ST. PAUL DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 1281 AN ORDINANCE REGULATING THE USE OF COAL TAR-BASED SEALER PRODUCTS The City Council of South St. Paul does ordain: SECTION 1. ENACTMENT. South St. Paul City Code Chapter 110 Article VII Section 140 hereby enacted as follows: SECTION 110-140. Coal Tar- Based Sealers. Subd. 1. Purpose. The City understands that lakes, rivers, streams and other bodies of water are natural assets which enhance the environmental, recreational, cultural and economic resources and contribute to the general health and welfare of the community. The use of sealers on asphalt driveways is a common practice. However, scientific studies on the use of driveway sealers have demonstrated a relationship between stormwater runoff and certain health and environmental concerns. The purpose of this ordinance is to regulate the use of sealer products within the City in order to protect, restore, and preserve the quality of its waters. Subd. 2. Definitions. Except as may otherwise be provided or clearly implied by context, all terms shall be given their commonly accepted definitions. For the purpose of this ordinance, the following definitions shall apply unless the context clear indicates or requires a different meaning: a.“Asphalt-based sealer” means a petroleum-based sealer material that is commonly used on driveways, parking lots, and other surfaces and which does not contain coal tar. b.“Coal tar” means a byproduct of the process used to refine coal. c.“Coal tar-based sealer” means a sealer material containing coal tar that is commonly used on driveways, parking lots and other surfaces. d.“MPCA” means the Minnesota Pollution Control Agency. e.“PAHs” means Polycyclic Aromatic Hydrocarbons, which is a group of organic chemicals formed during the incomplete burning of coal, oil, gas, or other organic substances. It is present in coal tar and believed harmful to humans, fish, and other aquatic life. Subd. 3. Use of Coal Tar-Based Sealer Prohibited. a. No person shall apply any coal tar-based sealer to any driveway, parking lot, or other surface within the City. b. No person shall contract with any commercial sealer product applicator, residential or commercial developer, or any other person for the application of any coal tar-based sealer to any driveway, parking lot, or other surface within the City. c. No commercial sealer product applicator, residential or commercial developer, or other similar individual or organization shall direct any employee, independent contractor, volunteer, or other person to apply any coal tar-based sealer to any driveway, parking lot, or other surface within the City. Subd. 4. Exemption. Upon the express written approval from both the City and the MPCA, a person conducting bona fide research on the effects of coal tar-based sealer or PAHs on the environment shall be exempt from the prohibitions provided in this ordinance. Subd. 5. Asphalt-Based Sealer Products. The provisions of this ordinance shall only apply to use of coal tar-based sealer in the City and shall not affect the use of asphaltbased sealer within the City. Subd. 6. Severability. If any provision of this ordinance is found to be invalid for any reason by a court of competent jurisdiction, the validity of the remaining provisions shall not be affected. SECTION 2. The Project is proposed to be specially assessed against buildable tax parcels either abutting, or served by said improvements. The areas and parcels, as specifically described herein, are subject to said special assessments. The buildable tax parcels abutting or served by the improvements are proposed to be assessed $4,500 per buildable tax parcel for those tax parcels abutting or served by Angell Road and $6,500 per buildable tax parcel for those tax parcels abutting or served by Windy Hill Road and Windy Hill Court. Information concerning project costs and the estimate of the assessments will be available at the hearing. A reasonable estimate of the impact of the assessments will be available at the hearing. The total estimated cost of the above listed improvements is $347,875. The total amount proposed to be assessed is $205,000, which is approximately 59% of the estimated cost of the Project. Persons desiring to be heard with reference to the proposed improvements will be heard at said time and place of the public hearing. Written or oral objections will be considered at the public hearing. The feasibility report concerning the improvements is on file with the City Clerk and the City’s Consulting Engineer.
