PLANNING CASE 18-003 

TOWHOM IT MAY CONCERN: 

NOTICE IS HEREBY GIVEN, that on Wednesday, March 7, 2018, at 6:30 p.m., the Arden Hills Planning Commission will hold a Public Hearing for an application from Bethel University for a Conditional Use Permit Amendment and Variance to construct two additions to existing buildings on the campus. The first addition would be an approximately 80 square foot addition on the Brushaber Commons building. The second addition would be an approximately 20,000 gross square foot addition on the Academic Commons building. A Variance is needed for the Academic Commons building addition to encroach within the 150-foot structure setback from Valentine Lake.

The City Council of the City of Roseville does ordain: 

SECTION 1. §1001.10 Definitions is hereby amended as follows:

Contractor yard: An establishment providing general contracting, building/site maintenance, or building construction services, including (but not limited to) outdoor storage of large construction equipment or machinery (loader, grader, bulldozer, scraper, crane or similar) trailers and/or seasonal equipment, and loose materials. Outdoor storage of these items shall be consistent with the requirements of Table 1006-1 and Section 1011.12.F.8, 9, and 10. 

Contractor yard – limited: An establishment providing general contracting, building/site maintenance, or building construction services, including (but not limited to) fleet vehicles (pick-up, cargo, and/or cube variety trucks), outdoor storage of trailers or machinery and/or seasonal equipment. Outdoor storage of these items shall be consistent with the requirements of Table 1006-1 and Section 1011.12.F.8, 9, and 10. 

Warehouse: An establishment providing storage and distribution of merchandise and bulk goods, typically involving heavy truck and/or freight rail traffic enclosed building with the principle use of storing materials or equipment. 

Distribution center: An enclosed building primarily used for receipt, temporary storage and redistribution of goods, typically involving heavy truck and/or freight rail traffic. 

SECTION 2. §1009.02.D. 30 (Conditional Use – Specific Criteria) is hereby amended as follows: 

e. Fleet vehicles: All outdoor storage shall occur on paved surfaces consistent with the parking area requirements of Section 1019.11 of this Title, and shall adhere to the parking area setback requirements in the applicable zoning district. Fleet vehicles in active use need not be screened, but inoperable or otherwise out-of-service vehicles (e.g., snow plows in the summer, or “retired” vehicles) shall adhere to the requirements for outdoor storage of inoperable/out-of-service vehicles or equipment.

Amy Jo Johnson, Director of Human Resources and Bridget Peterson, Director of Finance, presented the 2017-2019 tentative agreements with the Nutrition Services Association and the Paraprofessional Union. Discussion followed. Motion by Helgeson, seconded by Sager, to approve the proposed contracts between the School District and the Paraprofessional Union and the Nutrition Services Association for 2017-19. Voting aye: all; nay: none. Motion carried. 

Bridget Peterson presented a resolution authorizing issuance and sale of general obligation school building bonds. Motion by Helgeson, seconded by Sager, to approve the following resolution authorizing the issuance and sale of $153,575,000 general obligation school building bonds, series 2018A:

RESOLUTION AUTHORIZING ISSUANCE AND SALE OF $153,575,000 GENERAL OBLIGATION SCHOOL BUILDING BONDS, SERIES 2018A 

BE IT RESOLVED by the School Board (the Board) of Independent School District No. 621 (Mounds View), Minnesota (the District), as follows: 

SECTION 1. PURPOSE. It is hereby determined to be in the best interests of the District to issue its General Obligation School Building Bonds, Series 2018A, in the aggregate principal amount of $153,575,000 (the Bonds), subject to adjustment in accordance with the Terms of Proposal. The proceeds of the Bonds will be used, together with any additional funds of the District which might be required, to finance the acquisition and betterment of school sites and facilities as approved by the electors at a special election held on November 7, 2017. 

SECTION 2. TERMS OFPROPOSAL. Springsted Incorporated, in St. Paul, Minnesota (Springsted), municipal advisor to the District, has presented to this Board a form of Terms of Proposal for the Bonds which is attached hereto and hereby approved and shall be placed on file by the Clerk. Each and all of the provisions of the Terms of Proposal are hereby adopted as the terms and conditions of the Bonds and of the sale thereof. Springsted, as independent municipal advisor, pursuant to Minnesota Statutes, Section 475.60, Subdivision 2, paragraph (9), is hereby authorized to solicit proposals for the Bonds on behalf of the District on a competitive basis without requirement of published notice. 

SECTION 3. SALE MEETING. This Board shall meet at the time and place shown in the Terms of Proposal for the purpose of considering proposals for the purchase of the Bonds and of taking such action thereon as may be in the best interests of the District. 

SECTION 4. STATE CREDIT ENHANCEMENT PROGRAM. (a) The District hereby covenants and obligates itself to notify the Commissioner of Education of a potential default in the payment of principal and interest on the Bonds and to use the provisions of Minnesota Statutes, Section 126C.55 to guarantee payment of the principal and interest on the Bonds when due. The District further covenants to deposit with the Registrar or any successor paying agent three (3) days prior to the date on which a payment is due an amount sufficient to make that payment or to notify the Commissioner of Education that it will be unable to make all or a portion of that payment. The Registrar for the Bonds is authorized and directed to notify the Commissioner of Education if it becomes aware of a potential default in the payment of principal or interest on the Bonds or if, on the day two (2) business days prior to the date a payment is due on the Bonds, there are insufficient funds to make that payment on deposit with the Registrar. The District understands that as a result of its covenant to be bound by the provision of Minnesota Statutes, Section 126C.55, the provisions of that section shall be binding as long as any Bonds of this issue remain outstanding. 

(b) The District further covenants to comply with all procedures now and hereafter established by the Departments of Management and Budget and Education of the State of Minnesota pursuant to Minnesota Statutes, Section 126C.55, subdivision 2(c) and otherwise to take such actions as necessary to comply with that section. The chair, clerk, superintendent or business manager is authorized to execute any applicable Minnesota Department of Education forms.

Bridget Peterson reviewed the quarterly budget report for the period ending December 31, 2017. Discussion followed. Budget amendments were reviewed. Motion by Sager, seconded by Helgeson, to approve the budget amendments as presented. Voting aye: all; nay: none. Motion carried. 

Bridget Peterson presented 2018-19 budget assumptions. Discussion followed. Motion by Westerman, seconded by Helgeson, to approve the 2018-19 assumptions as presented. Voting aye: all; nay: none. Motion carried. 

Supt. Lennox and Cabinet members provided an update on the planning and preparation currently underway for start time changes that will take place beginning in the fall of 2018. Discussion followed. 

Amy Jones provided an AMSD update and Marre Jo Sager provided a Northwest Metro 916 update. 

Board member Jones presented the results of the Superintendent’s mid-year evaluation. 

As liaisons to schools and on committees, Board members reported on events in which they had participated
