NOTICE OF ASSOCIATION LIEN FORECLOSURE SALE 

WHEREAS, default has been made in the terms and conditions of the Declaration of Morgan Square Homeowners Association (henceforth the Declaration) dated June 19, 2003 and recorded in the office of the County Recorder in and for Dakota County, Minnesota on December 5, 2003 as Document No. 2148492 which said Lien covers the following described property situated in the County of Dakota and State of Minnesota, to-wit: 

Lot 17, Block 1, Morgan Square, C.I.C. No. 373, according to the plat thereof on file or of record in the Office of the County Recorder, in and for Dakota County, Minnesota.

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by Mary N. Ndegwa as unit owner, to Morgan Square Homeowners Association, the principal amount of Two Thousand Nine Hundred Twenty-seven Dollars and 53/100 ($2,927.53) for assessments through January, 2018 and no action being now pending at law or otherwise to recover said debt or any part thereof, and; 

WHEREAS, pursuant to said Declaration, said debt creates a lien upon said premises in favor of Morgan Square Homeowners Association. 

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Dakota County, Minnesota at the Sheriffs main office, Dakota County Courthouse, Civil Division, 1580 Highway 55-Lobby S-100 in the City of Hastings in said County on March 29, 2018 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorneys fees as allowed by law. The time allowed by law for redemption by the unit owners, her personal representatives or assigns, is six (6) months from the date of said sale. 

TIME AND DATE TO VACATE PROPERTY: If the real estate is an owner-occupied single family dwelling, unless otherwise provided by law, the date on or before which the unit owners must vacate the property if the lien is not reinstated under section 580.30 or the property is not redeemed under section 580.23 is 11:59 p.m. on September 29, 2018. If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate the property is the next business day at 11:59 p.m.

NOTICE OF PUBLIC HEARING ON THE VACATION OF A PORTION OF THE ALLEY LOCATED BETWEEN LOTS 1 THROUGH 15 AND LOTS 30 THROUGH 16, BLOCK 1, HEPBURN PARK ADDITION TO THE CITY OF ST. PAUL, DAKOTA COUNTY, MINNESOTA, PURSUANT TO MINNESOTA STATUTES § 412.851 AND § 462.358, SUBD. 7 AND CITY CODE SECTION 54-429 

TO WHOM IT MAY CONCERN: 

PLEASE TAKE NOTICE: 

1. The City of South St. Paul received the dedication of a twenty-foot alley between Lots 1 through 15 and Lots 30 to 16, Block 1, on the plat of Hepburn Park Addition to the City of St. Paul, Dakota County, Minnesota. 

2. The City now seeks to vacate a portion of that twenty-foot alley described as: 

All that part of the alley lying between Lots 14 to 17, inclusive, and lying between the South 20 feet of Lots 13 and 18, Block 1, Hepburn Park Addition to the City of St. Paul, Dakota County, Minnesota. 

3. Such vacation is subject to the reservation unto the City and other utility providers of a permanent easement for drainage and utility purposes, together with the right to enter upon such property or any portion thereof at any time and from time to time for the purpose of reconstructing, inspecting, maintaining, and repairing the same, over, across, under, through and upon that portion of the twenty-foot alley described above. 

4. Pursuant to Minnesota Statutes § 412.851 and § 462.358, subd. 7 and City Code Section 54-429, the City of South St. Paul shall hold a public hearing on the proposed vacation of all that part of the alley lying between Lots 14 to 17, inclusive, and lying between the South 20 feet of Lots 13 and 18, Block 1, Hepburn Park Addition to the City of St. Paul, Dakota County, Minnesota. 

5. Notice is hereby given that the City Council of South St. Paul shall hold a public hearing on said proposed vacation at 7:30 p.m. on the 20th day of February, 2018, at the City of South St. Paul City Hall, 125 - 3rd Avenue North, South St. Paul, Minnesota, 55075. 

6. A copy of the proposed Ordinance for the vacation of the above-described alley is attached hereto as EXHIBIT A – PROPOSED ORDINANCE. 

7. Those persons having an interest in said vacation are encouraged to attend this public hearing.

PAUL, DAKOTA COUNTY, MINNESOTA, SUBJECT TO THE RESERVATION OF AN EASEMENT FOR DRAINAGE AND UTILITY PURPOSES, PURSUANT TO MINNESOTA STATUTES § 412.851 AND § 462.358, SUBD. 7 AND CITY CODE SECTION 54-429

WHEREAS, notice of a public hearing on said vacation was duly published, posted and mailed in accordance with applicable Minnesota Statutes and City Code Section 54-429 and a public hearing was held on the 20th day of February, 2018, at the City of South St. Paul City Hall, 125 - 3rd Avenue North, South St. Paul, Minnesota, 55075; and 

WHEREAS, the City Council of South St. Paul then proceeded to hear all persons interested in said vacation and all persons interested were afforded an opportunity to present their views and objections to said vacation; and 

WHEREAS, the City Council of South St. Paul has determined that the vacation would be in the public interest. 

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF SOUTH ST. PAUL, MINNESOTA: 

1. That pursuant to Minnesota Statutes § 412.851 and § 462.358, subd. 7 and City Code Section 54-429, the City of South St. Paul hereby vacates a portion of the alley located between Lots 1 through 15 and Lots 30 through 16, Block 1, Hepburn Park Addition to the City of St. Paul, Dakota County, Minnesota legally described as follows: 

All that part of the alley lying between Lots 14 to 17, inclusive, and lying between the South 20 feet of Lots 13 and 18, Block 1, Hepburn Park Addition to the City of St. Paul, Dakota County, Minnesota. 

2. That said vacation has no adverse relationship to the City’s Comprehensive Plan and therefore the South St. Paul City Council has dispensed with the requirements of Minnesota Statutes § 462.356, subd. 2, that may require the South St. Paul Planning Commission to perform a Comprehensive Plan compliance review of said partial vacation that may constitute a disposal of an interest in real property pursuant to § 462.356, subd. 2. 

3. That pursuant to Minnesota Statutes § 160.29, subd. 2 and City Code Section 54-429, the City of South St. Paul reserves unto itself and other utility providers a permanent easement for drainage and utility purposes, together with the right to enter upon such property or any portion thereof at any time and from time to time for the purpose of reconstructing, inspecting, maintaining, and repairing the same, over, across, under, through and upon the following land described as follows, to-wit: 

All that part of the alley lying between Lots 14 to 17, inclusive, and lying between the South 20 feet of Lots 13 and 18, Block 1, Hepburn Park Addition to the City of St. Paul, Dakota County, Minnesota. 

4. That said vacation shall only become effective upon the execution and recording of a Permanent Public Street, Road, Alley, and Right-of-Way Easement (Permanent Right-of-Way Easement) by the owner of the property legally described on the attached Exhibit A, which Permanent Easement shall provide for access to the unvacated portion of the alley located between Lots 1 through 12 and Lots 30 through the northern half of Lot 15, Block 1, Hepburn Park Addition to the City of St. Paul, Dakota County, Minnesota.

A school board meeting was held at 6:00 p.m. on Monday, February 5, 2018 in the Council Chambers at the Mendota Heights City Hall, 1101 Victoria Curve, Mendota Heights, MN. The following School Board members were present: John Chandler, Brenda Corbett, Stephanie Levine, Joanne Mansur, Maureen Ramirez, Byron Schwab and Terry Stamman. Superintendent Peter Olson-Skog was present. Student Representative Rahel Mekonnen was present. 

A motion carried to approve the agenda. 

A motion carried to approve the consent agenda which included minutes; personnel recommendations; December 2017 accounts payable and treasurer’s report; and January 2018 wire transfers report. 

A motion carried to approve a resolution to support an application for the Innovation Research Zone Pilot Program. 

Site reports were presented for Heritage E-STEM Magnet School and Henry Sibley High School. 

An update on the TriDistrict Career and College Readiness Initiative was presented. 

The meeting adjourned at 7:35 p.m. 

The next regularly scheduled School Board meeting of Independent School District 197 is scheduled for Tuesday, February 20, 2018 at 5:00 p.m. at Henry Sibley High School, Room A241, 1897 Delaware Avenue, Mendota Heights, MN.

John Christiansen’s retirement; and Interview Ken LaCroix and BKB Associates as possible search consultants for the superintendent’s position. NOTICE IS HEREBY GIVEN that the Dakota County Community Development Agency (“CDA”) Board of Commissioners (the “CDA Board”), State of Minnesota, will hold a public hearing on February 27, 2018, at or after 3:30 p.m. in the Board Room at the Dakota County Community Development Agency offices, 1228 Town Centre Drive, Eagan, Minnesota, relating to the proposed use of funds from the existing CDA Tax Increment Financing District (Housing) No. 8 (the “TIF District”) to designate additional property in Inver Grove Heights, Minnesota to be acquired with tax increment for the development of a housing project (the “Amendment”) as defined in Minnesota Statutes, 469.174, subdivision 11, as amended. The specific property to be acquired is Property Identification No. 20-36500-19-020, legally described as Lot 2, Block 19, Inver Grove Factory Addition.
