Notice is hereby given that a public hearing will be held by the Dakota County Board of Commissioners on the 24th day of April, 2018 at 9:00 a.m. in the County Board Room of the Dakota County Administration Center, 1590 West Highway 55, Hastings, MN, for the purpose of receiving comments from the general public concerning the Dakota County 2018 Annual Action Plan. West Rink Floor Replacement 

Work generally consists of removing the existing concrete ice rink floor for the west rink; partial demolition of the equipment room piping; constructing a new concrete ice rink floor; new transmission mains; and connecting to the existing refrigeration system. Work includes demolition, excavation, concrete, piping, insulation, pump modifications, controls, and related items.

Contractors should be aware that any prime contractor, subcontractor, or motor carrier that does not meet the minimum criteria established for the “responsible contractor” as defined in Minn Stat. 16C.285, subd.3 or fails to comply with the verification requirements is not a responsible contractor and is not eligible to be awarded a construction contract for the project or to perform work on the project. A false statement under oath verifying compliance with any of the minimum criteria shall make the prime contractor, subcontractor, or motor carrier that makes the false statement ineligible to be awarded a construction project and may result in termination of a contract awarded to a prime contractor, subcontractor, or motor carrier that submits a false statement. A prime contractor shall include in its verification of compliance a list of all of its first-tier subcontractors that it intends to retain for work on the project. 

The bidder or sub-bidder shall be responsible for completeness and adequacy of the documents requested. 

The City reserves the right to retain the deposits of the 3 lowest Bidders for a period not to exceed 60 days after the date and time set for the Opening of Bids. No Bids may be withdrawn for a period of 60 days after the date and time set for the Opening of Bids. 

The City reserves the right to reject any and all Bids, to waive irregularities and informalities therein, and further reserves the right to award the Contract to the best interests of the City.

Assessment Roll Available for Inspection 

The proposed assessment rolls are now on file for public inspection at the Clerk’s Office, 8150 Barbara Avenue, Inver Grove Heights, MN. You are invited to examine the assessment rolls prior to the hearing. City offices are open from 8:00 a.m. to 4:30 p.m., Monday through Friday; no appointments are necessary. The assessment rolls will be available for examination at the hearing. 

Objections and Appeals 

Written and oral objections will be considered at the hearing. Minnesota Statute, Section 429.061, states that no appeal may be taken as to the amount of the assessment unless a written objection, signed by the affected property owner, is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. An owner may appeal an assessment to the District Court pursuant to Minnesota Statute, Section 429.081, by serving notice of the appeal upon the Mayor or the Clerk of the City within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or the Clerk. 

Assessment Deferment 

Under Minnesota Statutes, Section 435.193 to 435.195, the Inver Grove Heights City Council may, in its discretion, defer the payment of these special assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments, any homestead property owned by a person who is retired by virtue of a permanent and total disability, for whom it would be a hardship to make the payments, any homestead property owned by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service (as defined in Minnesota Statutes Section 190.05, subdivision 5(b) or 5(c)), as stated in the person’s military orders, for whom it would be a hardship to make the payments. When deferment of the special assessments has been granted and is terminated for any reason provided by law, all amounts accumulated, plus applicable interest, become due. Any assessed property owner meeting the requirements of this law and Resolution No. 09-13, adopted under it, may apply to the City Clerk on the prescribed form for such deferral of payment of these special assessments. If you qualify and wish a deferment, then contact the City Clerk. 

Authority to Specially Assess 

The proposed assessments are to be levied pursuant to Minnesota Statutes, Chapter 429. The improvements are proposed to be assessed on the combined basis of the frontage, current or future access of properties abutting or tributary to said improvements, and the number of units served. The areas, parcels, lots and pieces of property, as specially described herein, are subject to said assessments. The amounts set forth in this Notice are the proposed assessments. The City Council will consider the proposed assessments at the meeting and may levy the assessments at the meeting or at a later date. The City Council may levy and adopt special assessments that are the same or different than the proposed amounts. 

Payment of Special Assessments 

Once the special assessments are levied and adopted, the special assessments will be certified to the Dakota County Auditor to be extended on the property tax lists for collection with real estate taxes. Prior to this certification, however, the property owner may prepay the entire amount of the special assessment without any interest thereon provided the prepayment is received within 30 days after levy and adoption of the special assessments by the City Council (or at such later date determined by the City Council). If the property owner wishes to prepay the special assessments without any interest, then such payment must be made to the City of Inver Grove Heights at City Hall, 8150 Barbara Avenue, Inver Grove Heights, MN 55077. Partial prepayment of the special assessments is not presently allowed under the City ordinances; the prepayment, without interest, must be for the entire amount of the special assessments.

If prepayment is not received within thirty (30) days after the special assessments are levied and adopted by the City Council (or at such later date determined by the City Council), then: 

(a) The total principal amounts of the special assessments are divided into an equal number of annual installments. The proposed number of annual installments is ten (10) years. The number of annual installments will be decided by the City Council when the special assessments are levied. 

(b) The principal amounts of the special assessments shall bear interest at the rate determined by the City Council when the special assessments are levied. The proposed interest rate is 4.65 percent. 

(c) Interest begins to accrue from the date the special assessments are levied (or at such later date determined by the City Council). 

(d) The annual principal installments, together with interest accrued on the unpaid balance, are due and payable together with real estate taxes. 

(e) Interest on the entire special assessments, from the date of levy (or at such later date determined by the City Council) to December 31st of the year in which the first installment is payable, is added to the first principal installment. The first installment will be due and payable in 2019. 

(f) If in the future the property owner wishes to pay off the remaining balance of the assessments, then Minnesota Statute, Section 429.061, Subdivision 3, provides that such payment may be made to the County Treasurer, together with interest accrued to December 31st of the year in which payment is made as long as payment is made prior to November 15th; if the payoff occurs after November 15th, then interest for the next year is also added. 

If the adopted assessments differ from the proposed assessments as to any particular lot, piece or parcel of land, then the City will mail to the owner a notice stating the amount of the adopted assessments. Owners will also be notified, by mail, if the City Council adopts any changes in the interest rate or prepayment requirements from those contained in this Notice of Hearing.

A school board meeting was held at 6:00 p.m. on Monday, April 2, 2018 in the Council Chambers at the Mendota Heights City Hall, 1101 Victoria Curve, Mendota Heights, MN. The following School Board members were present: John Chandler, Brenda Corbett, Stephanie Levine, Joanne Mansur, Maureen Ramirez, Byron Schwab and Terry Stamman. Superintendent Peter Olson-Skog was present. Student Representative Rahel Mekonnen was present. 

A motion carried to approve the agenda. 

A motion carried to approve the consent agenda which included minutes; personnel recommendations; gifts to the district; February 2018 accounts payable and treasurer’s report; March 2018 wire transfers report; food service renewals for paper and supplies, bread products, and milk and dairy products; and a field trip for Branch Out students. 

A motion carried to approve a resolution to appoint election judges for the May 8, 2018 special election. 

Superintendent Olson-Skog presented information related to the May 8, 2018 School District 197 special election and required Review and Comment. 

The meeting adjourned at 7:00 p.m.

Board Chair, Matt Schaefer, called the meeting to order at 5:30 p.m. 

2. Roll Call –Board Clerk, Sherry Warrick, took roll call.

5. District Highlights 

Principal Quennel Cooper lead a group of Pine Bend Elementary fourth grade students in presenting diversity poems and singing “Lift Every Voice and Sing” to the board in honor of Black History Month. 

Director of Community Education, Barb Pierce, introduced one of the students who participated in the Winter One Act play. This year Simley High School Theatre presented The Internet is a Distract--Oh, Look a Kitten. 

6. Non-Agenda Item—There were no non-agenda items presented. 

7. Consent Agenda 

Motion by Member Gliva and a Second by Member Hanson to approve the Consent Agenda items as presented. 

Motion carried 7-0. 

Thank you to those who have donated to the school district this past month. Your generosity in support of our schools in the community are much appreciated as they make a difference for our students. 

8. Information Items 

A. Ben Kusch, the Lead Designer for the TriDistrict Career and College Readiness program, shared a Career and College Readiness update on the program, its current offerings, and plans for the future. 

B. Director of Community Education, Barb Pierce, presented an adult programming update with TriDistrict Community Education Older Adult Program Coordinator, Jessica Anderson, and Inver Grove Heights Parks and Recreation Department Recreation Superintendent, Tracy Petersen. 

They discussed the collaboration taking place for adult programming offered in Inver Grove Heights. 

C. Principal Quennel Cooper presented an update on Pine Bend Elementary school, including demographics and programming. Fourth grade teacher Ben Peine also shared a video to give board members an idea of daily life at Pine Bend. 

D. Committee Reports 

I. Member Warrick shared the Facilities Committee did not meet. District Staff have provided a couple of opportunities for teachers to learn and provide perspective to Flexible Classroom furnishings. 

II. Member Stensgard shared the Finance Committee met after the February 12 Work Session. The committee was updated on the year to date spending analysis which is on track with previous years, the monthly check register, a discussion on the purchase of the property adjacent to Salem Hills, the contract agreement with the Clerical group and the Clerical Contract Agreement. 

III. Member Lounsberry shared the Personnel Committee met at 4:30 pm prior to the February 12 Work Session. The committee was updated on the movement of substitutes services to Teachers on Call, the employee Health Insurance transition to a new provider, the contract agreement with the Clerical group, and contract negotiations with Paraprofessionals. 

IV. Member Gliva shared the Policy Committee met prior to the board meeting tonight to discuss the second half of the 700 Series Non-Instructional Operations policies and to begin reviewing the 100 Series School District policies. 

E. Membership Reports 

I. Equity Alliance MN –Member Nordstrom shared the Equity Alliance group met earlier this month. A Stillwater representative reported they did a pilot project on developing a survey that measured whether relationships are important and have an impact on MCA scores. The pilot group found that overall MCA scores had an impact from teachers who had individual conversations with students who participated in the survey. The fiscal year budget was approved and the fund balance was discussed. 

II. Association of Metropolitan School Districts (AMSD) Member Gliva and Superintendent Dave Bernhardson attended the AMSD monthly meeting. There were a number of legislators in attendance listening to needs for further special education funding in schools. 

III. Minnesota School Board Association (MSBA) Member Schaefer participated in a MSBA Harassment & What School Board and Administrators Need to Know webinar. The MSBA Day at the Capital is scheduled for Monday, March 19. This is a day for board members to meet with legislators to discuss special education and cross-subsidy funding. 

9. Action Items 

A. Approval of the 2018-2019 Achievement Integration Budget. 

Motion by Member Stensgard and a Second by Member Nordstrom to approve the 2018-2019 Achievement Integration Budget.

B. Approval of the Clerical Contract Agreement. 

Motion by Member Warrick and a Second by Member Gliva to approve the Clerical Contract Agreement.

C. Approval of the Inver Grove Heights Property Purchase. 

Member Warrick read the Resolution Approving the Purchase of the Inver Grove Heights Property. The board proceeded to a roll call vote. The board unanimously voted 7-0 in favor of the property purchase. 

10. Superintendent and School Board Comments 

A. Superintendent’s Comments 

School Safety is of the utmost importance in our school district. Our staff is focused on ensuring everyone is safe throughout the day. We work closely with the Inver Grove Heights Police Department to train our staff to be able to react to varied safety scenarios. Our Emergency Preparedness team that includes school, district, and Inver Grove Heights Police representation guides this process. As an example our staff will participate in tabletop safety scenario discussions at our Workshop Day on Friday, March 2. The past week was School Board Recognition Week. We thank each of you for your service and commitment to our students, staff and community. 

B. School Board Comments 

Board Chair, Matt Schaefer—Thank you to Pine Bend staff and Principal Quennel Cooper for hosting the board meeting. I took part in the Simley High School orientation night. Simley’s Principal, Jerry Sakala, and Career and College Readiness Lead Designer, Ben Kusch, discussed the course catalog and answered questions from those in attendance. 

Board Vice Chair/Treasurer, Cindy Nordstrom—Thank you to Dave Bernhardson for the work he has done on the executive team for Equity Alliance MN. Exciting time for the BEST Foundation, March 17th fundraising dinner and silent auction. Join us by registering online at It’s tournament time, good luck to all the participants. 

Board Clerk, Sherry Warrick—Thank you to Mr. Cooper and Pine Bend staff for joining us. I have been able to attend many winter activities and enjoy conversations with parents at these events. 

Board Member, Carrie Lounsberry—I attended Hilltop’s Hoping for Spring concert. The music teachers are phenomenal and I am impressed with the energy and passion of the students participating in the concert. 

Board Member, Sue Gliva —Thank you to Pine Bend for hosting tonight and to the 4th graders for their performance. Good luck to boy’s hockey team and to the 9 wrestlers that qualified for state. 

Board Member, Rachel Hanson— Myself and two other TriDistrict Advisory Board members are on a bylaw sub committee. We are making bylaws more clear and comprehensive to understand. I recently had the opportunity to write a graduate paper on the state of special education funding. The academic experience helps me appreciate the work we do on the board surrounding this topic. 

Board Member, Lynette Stensgard—Thank you to the students joining us from Pine Bend and to Principal Quennel Cooper. It is a joy to be a part of our elementary schools. I am excited about the direction we are moving our Career and College Readiness program. The changes we are making are intentional in ensuring we provide great opportunities for all learners. 

11. Upcoming Meeting Dates 

There is no Work Session in March. The next Regular School Board Meeting will be on Monday, March 12 at Simley High School in the Spartan Center at 5:30 p.m.

Any objections may be filed in the above named court and the same will be heard by the Court upon notice of hearing fixed for such purpose. 

Notice is hereby further given that informal appointment of Daniel Tweeton whose address is 776 Bridle Ridge Road, Eagan MN 55123, as Personal Representative of the Estate of the above-named Decedent, has been made. Any heir, devisee, or other interested person may be entitled to appointment as Personal Representative or may object to the appointment of the Personal Representative, and the Personal Representative is empowered to fully administer the Estate, including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate, unless objections thereto are filed with the Court (pursuant to Minn. § Stat. 524.3-607) and the Court otherwise orders, 

Notice is hereby given that ALL CREDITORS having claims against said estate are required to present the same to said personal representative or to the Court Administrator within four months after the date of this notice or said claims will be barred.
